Please read these Terms & Conditions carefully before using the Jayple application. By accessing or using Jayple, you agree to be legally bound by these terms.
Welcome to Jayple, a consumer mobile application developed and operated by JAvia ("Company," "we," "us," or "our"). These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and JAvia governing your access to and use of the Jayple application, website, and all related services (collectively, the "Service").
By downloading, installing, registering for, or otherwise accessing the Jayple application, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not access or use the Service.
JAvia reserves the right to modify these Terms at any time. Continued use of the Service after any such changes constitutes your acceptance of the revised Terms.
To create an account and use Jayple, you must meet the following eligibility requirements:
- You must be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater.
- You must have the legal capacity to enter into a binding contract.
- You must not have been previously suspended or removed from the Jayple platform by JAvia.
- Your use of Jayple must comply with all applicable local, state, national, and international laws and regulations.
By creating an account, you represent and warrant that you meet all of the above eligibility requirements. JAvia reserves the right to verify your eligibility at any time and to terminate your account if any eligibility requirement is not satisfied.
When you create an account with Jayple, you agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete at all times.
You are solely responsible for:
- Maintaining the confidentiality of your account credentials, including your password.
- All activities that occur under your account, whether or not you have authorized such activities.
- Notifying JAvia immediately of any unauthorized access to or use of your account at legal@javia.in.
- Ensuring that your account is not accessed by anyone under the age of 18.
JAvia will not be liable for any loss or damage arising from your failure to comply with these account security obligations. You may not transfer or assign your account to any other person or entity.
Jayple grants you a limited, non-exclusive, non-transferable, revocable license to use the application for personal, non-commercial purposes in accordance with these Terms.
You agree NOT to:
- Use the Service for any unlawful, fraudulent, or malicious purpose.
- Attempt to gain unauthorized access to any portion of the Service or any related systems or networks.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the application.
- Transmit any viruses, malware, or other harmful computer code through the Service.
- Harass, abuse, threaten, or intimidate other users or vendors on the platform.
- Post or transmit any defamatory, obscene, or unlawful content through the Service.
- Use automated scripts, bots, or scraping tools to access or collect data from the Service.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
Violation of any of the above may result in immediate suspension or termination of your account and may be reported to appropriate law enforcement authorities.
The Jayple application and all of its content, features, and functionality — including but not limited to all text, graphics, logos, icons, images, audio clips, data compilations, software, and the compilation thereof — are the exclusive property of JAvia and are protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws of India and international treaties.
The JAvia name, logo, and all related product and service names, design marks, and slogans are trademarks of JAvia. You are not permitted to use such marks without the prior written consent of JAvia.
You are granted no intellectual property rights or licenses under these Terms except for the limited, revocable license to use the application as expressly stated herein. Any unauthorized use of JAvia's intellectual property may result in civil and criminal penalties.
Jayple may allow users to post, upload, submit, or otherwise make available content, including reviews, ratings, comments, and profile information ("User Content"). You retain ownership of any intellectual property rights you hold in User Content you submit.
By submitting User Content, you grant JAvia a worldwide, royalty-free, non-exclusive, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, and distribute such content in connection with operating and improving the Service.
You represent and warrant that your User Content does not infringe any third-party intellectual property rights and does not violate any applicable laws. JAvia reserves the right, but not the obligation, to remove any User Content that it deems, in its sole discretion, to be in violation of these Terms or otherwise objectionable.
Jayple facilitates transactions between users and registered vendors. All payments made through the application are processed via secure third-party payment gateways. JAvia does not store your complete payment card information on its servers.
Refund Policy:
- Refund requests must be submitted within 48 hours of order delivery through the in-app support feature.
- Refunds are subject to the individual vendor's return and refund policy, which is displayed on each vendor's listing page.
- In cases of order non-delivery or significant discrepancy from the product description, JAvia may facilitate a refund at its sole discretion.
- Digital goods and services that have been accessed or downloaded are generally non-refundable.
- Approved refunds will be processed within 5 to 7 business days to the original payment method.
JAvia reserves the right to suspend or cancel any orders that it suspects to be fraudulent or in violation of these Terms. In such cases, any amounts paid may be withheld pending investigation.
The Jayple application is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
JAvia does not warrant that the Service will be uninterrupted, timely, secure, or error-free. JAvia makes no warranties regarding the accuracy, reliability, or completeness of any content provided through the Service, including vendor listings and product information.
To the fullest extent permitted by applicable law, in no event shall JAvia, its affiliates, directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service, even if JAvia has been advised of the possibility of such damages.
JAvia's total liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid to JAvia, if any, in the twelve months preceding the claim.
You agree to indemnify, defend, and hold harmless JAvia, its affiliates, officers, directors, employees, consultants, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Jayple application or Service.
- Your violation of these Terms or any applicable law or regulation.
- Your violation of any rights of a third party, including but not limited to intellectual property rights, privacy rights, or contractual rights.
- Any User Content you submit, post, or transmit through the Service.
JAvia reserves the right, at its own expense, to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with JAvia in asserting any available defenses.
JAvia reserves the right, in its sole discretion, to suspend, restrict, or terminate your access to the Jayple application and Service, with or without notice, for any reason, including but not limited to a breach of these Terms.
You may terminate your account at any time by contacting JAvia at legal@javia.in or through the account settings within the application. Upon termination:
- Your right to access and use the Service will immediately cease.
- JAvia may delete your account information and User Content, subject to applicable data retention laws.
- Any pending orders or transactions at the time of termination will be handled in accordance with JAvia's standard procedures.
- Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, indemnity, and limitations of liability.
These Terms and any disputes arising out of or relating to these Terms or the Jayple Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
Any legal action, suit, or proceeding arising out of or related to these Terms shall be instituted exclusively in the courts of competent jurisdiction located in India. You hereby consent to the personal jurisdiction and venue of such courts and waive any objection to the laying of venue in such courts.
Notwithstanding the foregoing, JAvia reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.
JAvia reserves the right to modify or replace these Terms at any time at its sole discretion. When we make material changes to these Terms, we will notify you by updating the "Last Updated" date at the top of this page and, where required by applicable law, by providing additional notice (such as an in-app notification or email).
Your continued use of the Jayple application following the posting of any revised Terms constitutes your acceptance of such changes. It is your responsibility to review these Terms periodically for any updates. If you do not agree to the revised Terms, you must discontinue your use of the Service.
